1. Acceptance of Terms

By accessing or using PicTimer ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

PicTimer provides embeddable countdown timer images for use in email marketing campaigns and websites. The Service includes a web-based timer builder, hosted timer images, and related APIs.

3. Accounts

You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and keep it up to date.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or to send unsolicited bulk email (spam)
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Reverse engineer, decompile, or disassemble the Service
• Use the Service to distribute malware, phishing content, or deceptive material
• Exceed your plan's usage limits through automated means designed to circumvent restrictions

5. Plans and Billing

The Service offers free and paid subscription plans. Paid plans are billed monthly or annually through Stripe. You may cancel your subscription at any time through your account settings. Refunds are handled on a case-by-case basis at our discretion.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by PicTimer. Timer images you create using the Service are yours to use as permitted by your plan. You retain ownership of any custom content (fonts, branding) you upload.

7. Limitation of Liability

The Service is provided "as is" without warranties of any kind. PicTimer shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service, including but not limited to loss of revenue, data, or business opportunities.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue the Service at any time with reasonable notice. Scheduled maintenance will be communicated in advance when possible.

9. Termination

We may terminate or suspend your account at any time for violation of these terms. Upon termination, your right to use the Service ceases immediately. You may request deletion of your data by contacting us.

10. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms. Material changes will be communicated via email or through the Service.
